Introduction to the common law (10h)

Lynsey Redfern, Head of Legal English, Université Côte d’Azur

• The many different meanings of « common law », comparison between the common law and the civil law systems, legal English as it compares to general English
• Precedent (court hierarchy, statutory interpretation techniques, case law reports, differences between the civil and criminal procedures, equity)
• Legal professions (portrayal in books and films, the difference between barrister and solicitor, qualification paths)

 

Constitutional Law and Administrative organization (8h)

Marc Peltier, Université Côte d’Azur
The aim of the course is to familiarize students with the UK Constitution. The first question is whether the UK has a constitution. It is then necessary to analyze the specific sources of the UK Constitution, which consist of legislation, notably relating to the devolution of powers to Scotland and Northern Ireland, but also of case law and conventions. Finally, the course concludes with the legal value of constitutional sources and their relation to other sources of law.

 

US Jurisprudence (7h)

Cynthia Boyer, Institut Universitaire Champollion
An introduction to the structure of the U.S. legal system, its Constitution and the powers, rights, and liberties it defines. This course will focuss on the fundamental principles and a common-law method of case analysis. Topics include with references to the Supreme Court’s jurisprudence: the principle doctrines, judicial review; limitations on judicial power; nature of and separation of powers; federalism, including the Commerce Clause state action; individual rights, procedural and substantive due process, and equal protection.
Students will study the structure of the U.S. court system, the sources of U.S. law, the lawyer's role in the system, and the culture of the law in this country.

 

Contract Law (10h)

• To understand the principles that have been laid down in the leading cases
• To learn how to apply those principles to a given set of facts
• To learn english legal vocabulary
• To understand the specificities of English approach by comparison to French approach

 

Criminal Law (7h)

Stéphanie Mc Lellan, Sciences Po Toulouse
The aim of this course is to introduce the students to the basic concepts of English criminal law, to understand criminal procedure and to focus on a few specific offenses with key criminal cases. The idea is to investigate these various aspects of English criminal law with a comparative approach and students will be encouraged to make comparisons with other criminal procedures such as the ones implemented in France or the USA.

Internet law and data protection (8h)

Dr TJ McIntyre, University College of Dublin

• Internet regulation in the UK generally - debates about online safety - role of self-regulatory bodies such as the Internet Watch Foundation - continued role of EU law post-Brexit
• Cybercrime in the UK - domestic legal framework - agreements with third countries around exchange of information
• Online defamation and privacy issues - how defamation works in England and Wales (and to a lesser extent elsewhere in the UK) - "Wagatha Christie" as an example - libel tourism and relevance to publishers in other jurisdictions
• Data protection after Brexit - changes in the UK system - what we mean by adequacy - impact of Brexit on data transfers to UK - future of adequacy agreement - possible economic implications
